[[Khalid Sheikh Mohammed]] decided that explosives were too risky to use in his next plot and chose instead to use airplanes. The plot was later revised and executed during the [[September 11 attacks]]. Khalid Sheikh Mohammed was arrested in [[Rawalpindi]], Pakistan in 2003. Yousef filed a motion for a new trial in 2001. The United States Court of Appeals for the Second Circuit heard the case on May 3, 2002, and announced on April 3, 2003, the decision that Yousef and his partners were to remain incarcerated.<ref name= appeals2>[http://news.findlaw.com/hdocs/docs/terrorism/usyousef40403opn.pdf Decision] (2003).
