==Elements== There are three elements to mail and wire fraud: # A mail or wire communication # a scheme and [[intention (criminal law)|intent]] to defraud someone # a [[material fact|material]] deception<ref name=":0">{{usc|18|1343}}</ref> Mail fraud applies only to United States domestic mailings and use of interstate carriers ([[United Parcel Service|UPS]], [[FedEx]]) which must originate in one state, and successfully terminate pursuant to the address label inside another state, a transportation that is termed "interstate" (over which [[United States Congress|Congress]] has power to regulate) and does require that the mailing cross at least one state line into another state;<ref name=":0" /> wire <ref name=":0" />fraud has been expanded by Congress to include foreign wire communication or interstate connections via (e.g.) an e-mail server or telephone switch or radio communication.<ref name = "overview">{{cite book |last1=Doyle |first1=Charles |title=Mail and Wire Fraud: An Abbreviated Overview of Federal Criminal Law |date=February 11, 2019 |publisher=Congressional Research Service |location=Washington, DC |url=https://crsreports.congress.gov/product/pdf/R/R41931/7 |access-date=26 March 2019}}</ref>
